Avoidprobate™ Advanced

Description:

AvoidProbate™ Advanced is designed for clients with more advanced estate planning needs such as estate tax planning, special needs children, children outside the marriage, or business tax planning.

What it includes:

The AvoidProbate™ Advanced estate plan includes the following documents, at minimum:

 

1. Revocable Living Trust: Designed to avoid probate and plan for periods of incapacitation.  Assets such as real estate can be "titled" in the name of the trust which will prevent them from going into probate when you die.  Assest in the trust can also be easily managed by a Successor Trustee if the initial Trustee is ever incapacitated.

2. Pour-Over Will: Transfers any assets that may end up in your estate over to the living trust upon death.

​

3. Power of Attorney for Health Care:  A document which allows you to name an agent who can make medical decisions for you in the event of incapacitation.

​

4. Power of Attorney for Property: A document that allows a named agent to manage assets that are not in the trust (i.e. bank accounts, retirement accounts, and more).

5. Custom created documents, as needed, which will be determined based on your particular situation.

The Process:

The process starts with a telephone meeting with an attorney. After the initial meeting, we will send you a form to collect some necessary information to prepare your documents. Once prepared, we will send you drafts of the documents to review.  If there are any revisions needed, just let us know.  Once the documents are ready to sign, you will be scheduled for an in-office meeting to go over all the documents one more time. During that meeting you will then execute all the documents with an attorney who can answer any questions you have.

A $250 deed preparation and recording fee will be added for each individual piece of real estate that you need us to "title" in the name of the trust.
